What is HOTMA?
Housing Opportunities through Modernization Act
The Housing Opportunities through Modernization Act (HOTMA) was signed into law by President Obama on July 29, 2016. HOTMA makes numerous amendments to Sections 3, 8, and 16 of the United States Housing Act of 1937(1937 Act), including significant changes to income calculation, net family assets, and income reviews. HUD finalized HOTMA rulemaking in 2023 to put Sections 102, 103, and 104 into effect through revisions to HUD's regulations found in 24 CFR Part 5 and 24 CFR Part 891. The plans currently in DRAFT format will be effective starting April 1, 2025 with the exceptions of Chapter 6B, 7B, 8B, and 11B. Chapter 8B replaces Chapter 8A upon HUD's implementation of NSPIRE standards. The implementation dates for NSPIRE standards have changed multiple times, and are currently anticipated to be readied in October of 2025. Chapter 6B, 7B, and 11B will be applicable following the GHA's HOTMA 102/104 Compliance Date which is currently June 1, 2025 but Public Housing Authorities have been advised that a delay in implementation is possible.
